By accessing or using PopSmiths ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our Service.

2. Service Description

PopSmiths provides AI-powered image transformation services that convert user-uploaded photos into artistic renderings. These artworks can be purchased as physical prints, canvas, framed products, apparel, and accessories.

3. User Responsibilities

• You must own or have rights to any photos you upload.
• You may not upload content that infringes on others' intellectual property.
• You may not upload illegal, harmful, offensive, or explicit content.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years old (16 in the EEA/UK) to use the Service.

4. Intellectual Property

You retain ownership of your original photos. The AI-generated artwork created from your photos is licensed to you for personal and commercial use. You may display, print, and share your artwork. PopSmiths retains no exclusive ownership claim over your individual outputs.

By uploading content, you grant PopSmiths a limited license to store, process, and display your content solely to provide the Service.

5. Purchases & Payments

• All prices are in USD unless otherwise stated.
• Payment is processed securely through Shopify Payments or Stripe.
• Prices may change without notice; orders are locked at the purchase price.
• Digital credits are non-refundable once used. See our Refund Policy for physical product returns.

6. Shipping & Delivery

Shipping times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or events beyond our control. Risk of loss transfers upon delivery to the carrier. See our Shipping Policy for details.

7. Limitation of Liability

PopSmiths is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid for the specific Service giving rise to the claim.

8. Governing Law

These Terms are governed by the laws of the State of California, USA. Disputes shall be resolved in the courts of Los Angeles County, California.

9. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance. We will notify you of material changes by email or prominent notice on the Service.
