PopSmiths, LLC ("PopSmiths," "we," "our," or "us") operates the PopSmiths platform and related services. This Privacy Policy explains how we collect, use, and protect your personal information — including photos and AI-generated artwork — when you use our Service.

1. Information We Collect

Information You Provide

• Account: Email address and display name when you register.
• Photos: Images you upload for AI art transformation (selfies, pet photos, family photos).
• AI artwork: The artwork outputs generated from your photos.
• Orders: Shipping address and order history for physical products.
• Payment: Billing details processed by Shopify Payments / Stripe. We do not store card numbers.

Collected Automatically

• Usage data, device info, IP address, browser type, and session cookies.
• Analytics data (aggregated, anonymized).

2. How We Use Your Information

• Transforming your photos into AI artwork and powering your personal gallery.
• Processing and shipping physical product orders.
• Account management, customer support, and fraud prevention.
• Sending order confirmations and (with consent) promotional emails.
• Legal compliance (CCPA, GDPR, COPPA).

We do not sell your photos or use them to train AI models without your explicit consent.

3. Photos, AI Processing & Artwork

Photos you upload are transmitted securely to our AI partners (Kie.ai, Replicate, and others) solely to generate the artwork you requested. Images are stored to power your gallery and video features. You may delete any artwork or your account at any time. Backups are purged within 90 days.

When you mark artwork Public, it appears in our community gallery visible to all visitors. You can change any item to Private at any time from your account settings.

You retain ownership of your original photos. You receive a broad license to use, print, and share your AI-generated artwork for personal and commercial purposes.

4. Third-Party AI Providers

Our transformation pipeline uses Kie.ai, Replicate, and cloud storage providers. These are contractually restricted from using your images for any purpose other than processing your requests. We do not permit providers to train AI on your images.

5. Data Sharing

We do not sell your personal information. We share only with:

• AI & hosting providers to operate the Service.
• Print partners (Gelato, Gooten, Printful) for order fulfillment — name, address, and artwork only.
• Payment processors (Shopify Payments, Stripe) — PCI-DSS compliant.
• Law enforcement when required by law or to protect safety.

6. Data Security

We use TLS/SSL encryption in transit, encrypted storage at rest, access controls, and regular security reviews. No system is 100% secure; we will notify you of any breach as required by law.

7. Cookies

We use cookies to keep you logged in, remember preferences, and analyze usage. You may disable cookies in your browser, though some features may not work. Contact [email protected] to opt out of analytics.

8. California Privacy Rights (CCPA/CPRA)

California residents may request to know, delete, or correct their personal information, or opt out of sale/sharing (we do not sell data). Submit requests to [email protected]. We respond within 45 days.

9. European / UK Privacy Rights (GDPR)

EEA/UK residents have rights to access, rectify, erase, restrict, or port their data, and to object to processing. Our legal bases are contract performance, legitimate interests, consent, and legal obligation. We use Standard Contractual Clauses for international transfers. 10. Your Rights (All Users)

• Update account info in settings.
• Delete individual artworks or your entire account.
• Toggle any item between Public and Private.
• Opt out of marketing emails via the unsubscribe link.
• Request a copy of your data.

11. Children's Privacy

The Service is not directed to children under 13 (or 16 in the EEA/UK). If your child has provided information without consent, contact us immediately and we will delete it.

12. Data Retention

• Account data: retained while active + up to 2 years after deletion.
• Photos & artwork: until you delete them. Backups purged within 90 days.
• Order records: 7 years for financial compliance.
• Server logs: up to 12 months.
